1. Acceptance of Terms

These Terms of Service ("Terms") are entered into by and between you and the UPRETI FOUNDATION TRUST ("Foundation", "we", "us", or "our"). The following terms and conditions strictly govern your access to and use of our website and services. By accessing, browsing, or using this website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the website.

2. Scholarship & Academy Applications

The Foundation provides an application portal for various scholarships and educational programs. By submitting an application, you agree to the following strict conditions:

  • Absolute Discretion: The Foundation retains sole, absolute, and unchallengeable discretion in the selection of scholarship recipients and Academy participants.
  • No Guarantee of Funding: Submission of an application, regardless of qualifications, in no way constitutes a guarantee of funding, acceptance, or support.
  • Accuracy of Information: You certify that all information provided is accurate, truthful, and complete. Any misrepresentation, falsification, or omission will result in immediate disqualification and potential revocation of any awarded funds.
  • Final Decisions: All decisions made by the Foundation's review board are final and not subject to appeal, review, or justification.

3. Intellectual Property Rights

The website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the UPRETI FOUNDATION TRUST, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are strictly prohibited from copying, modifying, creating derivative works of, publicly displaying, publicly performing, republishing, downloading, storing, or transmitting any of the material on our website without our prior written consent.

4. Prohibited Uses

You may use the website only for lawful purposes and in accordance with these Terms. You strictly agree not to use the website:

  • In any way that violates any applicable federal, state, local, or international law or regulation.

You agree to defend, indemnify, and hold harmless the UPRETI FOUNDATION TRUST, its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the website.

8. Governing Law and Jurisdiction

All matters relating to the website and these Terms, and any dispute or claim arising therefrom or related thereto, shall be governed by and construed in accordance with the internal laws of the State of Uttarakhand, India, without giving effect to any choice or conflict of law provision or rule.
